Release of Liability

READ THIS ENTIRE RELEASE BEFORE YOU CREATE AN ACCOUNT. By checking the acceptance box, redeeming an access code, or using HUNTECH, you agree that you assume all risk and that HUNTECH has no liability to you for hunting, land use, injury, death, property damage, or reliance on any map, playbook, grade, or AI output.
This Release of Liability, Waiver of Claims, and Assumption of Risk (the "Release") is given by you in favor of HUNTECH and its owners, officers, employees, contractors, affiliates, licensors, and successors (together, the "Released Parties"). It is part of the Terms of Service. If you do not accept this Release, you may not use the Service.
1. Acknowledgement of inherent danger
You understand that hunting, scouting, hanging stands, running cameras, using firearms or bows, climbing, operating ATVs or other vehicles, walking remote terrain, and being in the woods are inherently dangerous. Risks include, without limitation:
- Firearm and archery accidents, including negligent or accidental discharge by you or others.
- Falls from treestands, ladders, climbing sticks, blinds, or terrain.
- Injury or death from weather, flooding, lightning, heat, cold, hypothermia, or getting lost.
- Injury from wildlife, livestock, insects, plants, or other people.
- Vehicle accidents on roads, two-tracks, fields, or private lanes.
- Trespass disputes, confrontations, citation, arrest, or civil claims related to land access or hunting regulations.
- Errors in maps, GPS, satellite imagery, LiDAR, property lines, or AI recommendations that lead you into unsafe, illegal, or unauthorized places.
These risks cannot be eliminated. YOU VOLUNTARILY ASSUME ALL OF THEM, KNOWN AND UNKNOWN, EVEN IF THEY ARISE FROM THE NEGLIGENCE OF THE RELEASED PARTIES, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
2. HUNTECH outputs are not advice you may blindly follow
HUNTECH generates informational hunting-strategy content. It does not inspect the property with you. It does not know current crop conditions, recent logging, new houses, posted signs, or whether you have permission. It does not replace:
- Hunter education and safe firearm / stand practices.
- Written permission and your own verification of every property line.
- Current state and federal hunting regulations, which you must confirm with the governing agency before every hunt.
- Your judgment in the field. If an output conflicts with safety, law, or a landowner's rules, you must ignore the output.
You agree that any stand, route, wind, bed, or timing suggestion is a starting point for your own verification — not an instruction you are required or advised to follow if it is unsafe or illegal.
3. You accept all liability
YOU — NOT HUNTECH — ARE SOLELY AND EXCLUSIVELY LIABLE FOR:
- Every hunt, sit, drive, walk, climb, and shot you take, and every stand or camera you hang.
- Injury, disability, or death to yourself or anyone else, including hunting partners, clients, family, and the public.
- Damage to land, crops, fences, vehicles, equipment, or livestock.
- Trespass, poaching, tag or season violations, and any fine, seizure, or lawsuit.
- Purchasing, leasing, or walking away from land based on a HUNTECH grade, playbook, or comparison.
- Client or guest claims if you are an outfitter, guide, agent, or landowner using the Service.
You release the Released Parties from all of the above. You will not sue, claim against, or seek contribution from the Released Parties for those matters.
4. Waiver and covenant not to sue
To the maximum extent permitted by law, you waive, release, and forever discharge the Released Parties from any and all claims, demands, causes of action, damages, and expenses of every kind, whether in contract, tort (including negligence), strict liability, or otherwise, arising out of or related to: (a) your use of HUNTECH; (b) reliance on any output; (c) hunting or fieldwork; (d) land access; or (e) the unavailability, inaccuracy, or failure of the Service.
You covenant not to sue the Released Parties for any such claim. This Release binds your heirs, executors, insurers, and assigns. You intend it to be as broad as the law allows. If a court finds any part unenforceable, the remainder stays in force, and any claim that cannot be waived is still subject to the liability limits in the Terms of Service.
5. Indemnity
You will indemnify, defend, and hold the Released Parties harmless from any claim by a third party (including a hunting partner, guest, client, landowner, or government authority) arising from your conduct, your hunting, your land access, or your use of HUNTECH outputs, including reasonable attorneys' fees.
6. No refunds
You acknowledge that memberships, access codes, playbooks, Land Intelligence scans, and reports are sold under an all-sales-final policy. Paying for the Service does not buy insurance, a harvest guarantee, or a right to a refund if you are injured, unsuccessful, or dissatisfied. See the Refund & Return Policy.
7. Electronic signature
Checking the Release box at signup, or otherwise indicating acceptance, is your electronic signature. You agree it is as valid as a handwritten signature under the U.S. Electronic Signatures in Global and National Commerce Act and applicable state law. We may store the time, legal-document version, and account identity of your acceptance.
